All Designs are All Ours - Just Dandy Stuff

JUST DANDY STUFF is exactly just that – JUST DANDY STUFF.

All designs are uniquely created solely by Just Dandy Stuff designers and staff members.  From idea, to concept to design Just Dandy Stuff creates its own creative elements on its products.

All designs are the intellectual property of dandy stuff corporation and all its subsidiaries including just dandy stuff.  Most if not all works are trademarked or pending registered trademark.  Copying any of these designs besides being morally wrong is against the law and Just Dandy Stuff is prepared to pursue all legal channels to protect its intellectual property and the designer.  For legal clarity, see below definitions of legal terms and concepts.

Just Dandy Stuff does not copy other works.  Granted in such an expansive marketplace there appears to be crossovers in designs, however, our designers create based on their concept and ideas regardless of which “bestsellers” exist in the current marketplace.

Besides being morally dishonest to search the marketplace for bestselling concepts and mimic them to profit from someone else’s original designs and hard work or infringe on a particular market share of a concept or design, Just Dandy Stuff does not partake in this industrywide practice trend.  Our policy promotes the creative mind and creates purely based on the “fun of it” to express thoughts to share either whimsical, inspirational, or just every day concepts.

Our designs are unique.  Our designs are original.  Our designs are our intellectual property.

Just Dandy Stuff expresses itself You-Niche-Ly ™ and provides you the ability to share your you-niche-ness™.

INTELLECTUAL PROPERTY AND LEGAL TERMINOLOGY

DEFINITIONS:

COPYRIGHT law protects the expression of an original idea recorded in a tangible form, such as artwork in the form of photographs or paintings and literary works in the form of poems or stories.

TRADEMARK law protects the use of words, symbols, designs or logos that identify and distinguish a source of goods.

PUBLICITY RIGHTS protect an individual’s name, image and likeness. Basically this means you can’t use someone else’s identity, to your commercial advantage, without their consent.

A NOTE ON FAIR USE: You might be able to incorporate someone else's copyright or trademark into your own work, if you do it in such a way that that is considered "fair use" or in such a way that qualifies as another permissible use. However, please be aware that “fair use” typically applies in limited circumstances and isn’t the same as “freedom of speech”. Quite frankly “fair use” is a difficult concept, even for the experts, and the scope of “fair use” is different in different countries. So even if you think you’ve created a work covered by “fair use” or another permissible use, you should talk to an attorney prior to using any designs similar to our unique designs. While some uses might appear “fair” or permissible to you, we ask as a general rule that you if you must give pause on the legality of whether or not to use it, then don’t.  while we promote and encourage inspired environments, please don’t infringe on the rights of any of just dandy stuff’s designs.
